By accessing or using Caroussel.ai (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Caroussel.ai is an AI-powered content creation platform that enables users to:

  • Generate carousel content using artificial intelligence
  • Create and edit visual content for social media
  • Connect social media accounts (Instagram, TikTok) for direct publishing
  • Schedule and manage social media posts
  • Export content in various formats

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and update your information to keep it accurate
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account
  • Not share your account or credentials with others

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. Third-Party Platform Integration

4.1 Social Media Connections

When you connect your Instagram or TikTok account to Caroussel.ai, you:

  • Authorize us to access your account information as described in our Privacy Policy
  • Grant us permission to publish content on your behalf when you initiate a publish action
  • Understand that we will store access tokens securely to maintain the connection
  • Can revoke access at any time through your account settings or the third-party platform

4.2 Compliance with Platform Terms

When using our Service to publish content to third-party platforms, you agree to comply with:

Violation of third-party platform terms may result in suspension of your access to publishing features or termination of your Caroussel.ai account.

4.3 Platform Availability

We do not guarantee the availability or functionality of third-party platform integrations. These platforms may change their APIs, terms, or functionality at any time, which may affect our ability to provide certain features.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Infringe on intellectual property rights of others
  • Create, distribute, or promote illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
  • Generate spam, misleading content, or engage in deceptive practices
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any systems or accounts
  • Use automated means to access the Service without our permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for any fraudulent or illegal purpose

5.1 AI-Generated Content Guidelines

When using AI features to generate content, you agree not to:

  • Generate content that promotes violence, hate speech, or discrimination
  • Create misleading or false information (misinformation/disinformation)
  • Generate content that infringes on others' intellectual property
  • Attempt to bypass content safety filters or restrictions
  • Use generated content for illegal activities

6. Content Ownership and Rights

6.1 Your Content

You retain ownership of content you create or upload (“User Content”). By using our Service, you grant us a limited, non-exclusive, royalty-free license to:

  • Store and process your content to provide the Service
  • Display your content to you within the Service
  • Transmit your content to third-party platforms when you authorize publishing

This license terminates when you delete your content or account.

6.2 AI-Generated Content

Content generated using our AI tools is considered your User Content once generated. You are responsible for reviewing and ensuring AI-generated content complies with applicable laws and platform guidelines before publishing.

6.3 Our Intellectual Property

The Service, including its design, features, code, and documentation, is owned by Caroussel.ai and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7. Subscription and Payments

7.1 Free and Paid Plans

Caroussel.ai offers both free and paid subscription plans. Paid plans provide additional features, higher usage limits, and priority support.

7.2 Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice to existing subscribers
  • Failed payments may result in suspension of paid features

7.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds are provided for partial billing periods.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Disclaimers

9.1 Service Provided “As Is”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 AI Limitations

AI-generated content may contain errors, inaccuracies, or inappropriate material. You are responsible for reviewing all AI-generated content before use or publication. We do not guarantee the accuracy, quality, or suitability of AI-generated content.

9.3 Third-Party Services

We do not control third-party platforms (Instagram, TikTok) and are not responsible for their availability, policies, or content decisions. Your use of third-party platforms is at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAROUSSEL.AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to or use of our servers
  • Damages resulting from third-party platform actions or policies
  • Content or conduct of any third party on the Service

Our total liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Caroussel.ai, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you publish to third-party platforms through our Service

12. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and User Content
  • Provisions that by their nature should survive will remain in effect
  • You may request your data before termination takes effect

13. Governing Law and Disputes

These Terms are governed by the laws of France, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Paris, France, unless otherwise required by applicable consumer protection laws.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Caroussel.ai regarding the Service
  • Severability: If any provision is found unenforceable, the remaining provisions will continue in effect
  • Waiver: Our failure to enforce any right does not waive future enforcement of that or any other right
  • Assignment: You may not assign these Terms without our consent; we may assign them freely
